In October 2020, the Department of Labor (DOL) issued an Interim Final Rule (IFR), “Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States”, which amended the computation of prevailing wage levels for Labor Condition Application and Permanent Labor Certification. As expected, the said IFR met with flurries of legal challenges which resulted in court orders vacating the said IFR In compliance of court orders the DOL is making changes to the FLAG system to implement the OES prevailing wage data that was in effect on October 7, 2020.
